General Terms of Use & Conditions of Sale
These General Terms and Conditions govern the use of the CELESTA website (hereinafter "the Site") and the sale of show production services performed by CELESTA.
1. Services Provided
CELESTA designs, produces, and executes pyrotechnic shows, drone light shows, special effects, and multimedia staging (sound & light, video mapping). Each show is subject to a detailed quote and specific technical specifications agreed upon with the Client.
2. Permits and Regulations
The execution of shows is subject to obtaining the necessary regulatory approvals (flight permits from the DGAC and local prefectures for drones, fireworks discharge declarations with municipal and regional authorities, landowner agreements). CELESTA handles the associated administrative procedures. The Client agrees to provide all elements required for permit applications in a timely manner.
3. Orders, Deposits, and Payments
An order is only final upon receipt of the quote signed and dated by the Client, accompanied by a deposit payment (usually 30% to 50% of the total amount). The remaining balance is payable upon receipt of the final invoice, within the deadlines agreed and stated on the invoice.
4. Weather Conditions and Force Majeure
Outdoor performances (fireworks, drone flights) depend on weather conditions. For drone flights, if wind speeds exceed 30 km/h, or in the event of heavy rain or lightning, the flight may be cancelled or postponed by the flight director for imperative safety reasons. If cancellation occurs on the day of the show due to meteorological force majeure or flight denial by aviation authorities beyond the control of the company, the deposit paid will remain acquired by CELESTA to cover the technical, logistical, and administrative costs incurred.
5. Security and Exclusion Zone
A regulatory safety exclusion zone must be strictly respected during setup, show execution, and teardown. The Client agrees to guarantee free access to the site for CELESTA crews and equipment, and to enforce this safety perimeter to prevent public or unauthorized access.
6. Intellectual Property
Artistic concepts, storyboards, custom soundtracks, as well as drone light show choreographies and 3D flight paths remain the exclusive intellectual property of CELESTA. Any use, reproduction, or adaptation of these concepts without prior written consent is strictly prohibited.
7. Disputes and Applicable Law
These terms and conditions are governed by French law. Any dispute concerning the interpretation or execution of services will, in the absence of an amicable settlement, be submitted to the Commercial Court of VERSAILLES, France.
